T Riley ruled Wednesday Riley dismissed a I suit 2 against the fhe state stale ad aid Agriculture Com Corn Commissioner CommISSIOner missioner Dexter Dex r Daus Dasis Da IS It had been brought by Charles Bo- Bo Bard gard of St. St Louis County Bo- Bo Bogard Board Bagard gard ard said his wife ife Jacqueline died dJ of injuries sustained from the accident He lie contended the tate state vas at fault ault because of its failure to provide pros pro ide suitable barriers or safety safelY tones ones to pre tire prevent vent ent spectators from coming into dangerous proximity to the therace therace race track He asked the max max- under the states state's wrong wrong- wrongful ful rut death statutes Mrs Bogard was one of four persons killed when a racing r car crashed into a crowd of spectators Fourteen persons were ere tre injured Riley also aiso dismissed the suit against Roy Crans Crane of Claycomo allegedly alleged the driver of the rac rae racing racin tog ing in car that crashed into the crowd Also dismissed was the suit against National Speedways of South Carolina promoter of the race Riley Rile did not riot rule on the li liability li- li liability ability of Crane or National Speedways Speed ays but said only that they the could not be tried in the Cole County Circuit Court Suit Suil would base ha ha e to b be brought in their home counties
